Terms of Service
These terms describe how Elegant Driving School Inc. ("the school", "we") provides driving lessons, training packages, and related services, and what we ask of you as a customer.

Our services
Elegant Driving School Inc. offers Class D driving lessons, 5-hour pre-licensing courses, road test support, CDL Class A training, School Bus training (Class BP / Class BPS), and related services. By enrolling online, calling, or visiting the school, you agree to these terms.
Our services are for customers who hold, or are in the process of obtaining, the appropriate learner permit or license for the training they select.
Online enrollment is a request, not a confirmed lesson
Submitting the online enrollment form and paying places an enrollment request with the school. It does not by itself reserve a lesson date, road test appointment, or training slot. Your enrollment is confirmed when the school contacts you to schedule.
If we cannot accommodate your request, we will work with you on alternatives or a refund under our Refund & Cancellation Policy.
You must bring your permit or ID
Bring your valid learner permit or driver license to every lesson. New York State regulation requires our instructors to confirm you hold a valid credential before providing any behind-the-wheel instruction.
If you arrive without it, or if it has expired, we cannot give you the lesson, and it will be treated as a late cancellation under the rules below. We're sorry to be strict about this — it isn't our rule, and an instructor who ignores it puts their certification at risk.
Scheduling, arriving, and cancelling
Lessons are scheduled directly with the school by phone or in person.
Arriving late. Please arrive on time. Your instructor and vehicle are reserved for a set period and we can't extend into the next student's lesson, so a late arrival shortens your lesson.
Cancelling. To cancel or move a lesson without losing it, give us at least 24 hours' notice — call (718) 466-7717. There's no charge and no limit on rescheduling with proper notice, subject to availability.
Cancelling late, or not showing up. If you cancel with less than 24 hours' notice or don't arrive, the lesson counts as taken. Your instructor and vehicle were held for you and couldn't be given to another student.
- Class D — you may pay $40 to reschedule that lesson instead of losing it. That's your choice; you can also let it go. Tell us before your next scheduled lesson. The $40 covers rescheduling a lesson that has already been used and is not refundable.
- CDL Class A and School Bus — the lesson is forfeited and no paid reschedule is available. These vehicles and instructors are booked well in advance and can't be reassigned at short notice.
Whatever the situation, calling us always leaves you better off than not calling. Even short notice may let us fill the slot.
Package expiry
Packages expire 6 months from the date of purchase. Lessons not used within that period are forfeited.
If something serious comes up — a medical situation, a pregnancy, a college term away — talk to us. We can often pause a package for a defined period. Ask before your package expires; we can't restore one after it lapses.
Transferring a package
A package or services can be transferred to a family member or friend. Please contact the school to arrange it.
Payment
Listed prices reflect in-store rates. Payment may be made in person at the school or online through a secure hosted payment page.

Your total, including any fee, is always shown before you pay.
Split payments. Some packages may be paid in two parts. Where a split is agreed, the balance remains owed to the school and becomes due as arranged when you enroll. You may pay the balance by any accepted method. We do not keep your card on file or charge you automatically — you choose how and when to pay the balance within the agreed terms.
Card details. Card payments are handled entirely by our payment processor on its own secure page. The school never sees or stores your card number.
Refunds
Refund and cancellation terms are set out in our Refund & Cancellation Policy, which forms part of these terms.
Road tests and availability
Road test appointment dates and locations are controlled by the DMV and may be limited. Package contents, vehicle availability (car, bus, or truck), and scheduling depend on demand and DMV availability, and are not guaranteed for a specific date until confirmed by the school.
Where a package includes a road test appointment or DMV fee, that money is paid to the DMV, not kept by us. Once the DMV has taken a fee it is subject to the DMV's rules, and we cannot recover it on your behalf.
Your information must be accurate
You are responsible for giving us accurate information — especially your permit or license details, which must match your document exactly. Incorrect information can delay scheduling, void a road test appointment, or cause extra DMV fees. The school is not responsible for costs caused by inaccurate information you provide.
Students under 18
If you are under 18, a parent or guardian enrolls alongside you and is jointly responsible for payment. They are our contact for payments and refunds, and either of you may ask about your account at any time.
Electronic records and signatures
When you check the agreement boxes on our enrollment form and submit it, you are signing this agreement electronically. You agree your electronic acceptance has the same legal effect as a handwritten signature, and that we may keep that record electronically.
To make the record reliable, our system stores the date and time you accepted, the internet (IP) address and browser the acceptance came from, and the version numbers of these terms and the privacy policy in effect at that moment. This is described in our Privacy Policy.
You may request a paper copy of these terms, or complete your enrollment on paper at the school, at any time.
How we contact you
We use your phone number and email address to contact you about your enrollment — confirmations, scheduling, and payment questions. Our system also sends automated enrollment and scheduling emails.
These are messages about your own training, not marketing. We do not send promotional messages without asking your permission first.
Limitation of liability
To the fullest extent permitted by law, the school's total liability arising out of or relating to your enrollment, this website, or the services described here is limited to the amount you actually paid to the school for the service in question.
We are not responsible for indirect, incidental, special, or consequential damages — including lost wages, missed work, transportation costs, or a delayed license — arising from circumstances outside our reasonable control. These include, without limitation: DMV system, portal, or scheduling outages; changes to DMV appointment availability, requirements, or fees; road test cancellations by the DMV or its examiners; weather; vehicle breakdown; and interruptions to this website or our payment provider.
Nothing in these terms limits any liability that cannot lawfully be limited. In particular, this section does not apply to personal injury, death, or property damage, to gross negligence or willful misconduct, to any right you have under New York consumer protection law, or to any right you have under New York State DMV regulations governing driving schools.
Governing law and where disputes are heard
These terms, and any dispute arising out of them or out of the services we provide, are governed by the laws of the State of New York, without regard to its conflict-of-law rules. The school operates from and delivers all instruction within New York State.
You and the school agree that any legal action will be brought in the state or federal courts located in Bronx County, New York, and both of us consent to the jurisdiction of those courts.
Nothing in this section takes away any right you have under the New York General Business Law or any other consumer protection statute, and nothing here prevents you from bringing a claim in small claims court.
Resolving a problem
If something goes wrong, please contact the school first at (718) 466-7717 or contactus@elegantdrivingschool.com. Most scheduling, billing, and refund questions are resolved directly and quickly. We ask for the chance to fix a problem before it becomes a formal dispute, but you are never required to wait before exercising your legal rights.
Changes to these terms
We may update these terms as our services, prices, or legal obligations change. Each version carries a version number and effective date, shown at the top of this page.
The version in effect when you enrolled is the version that governs your enrollment. We record the version number you accepted with your order, so a later change to this page does not retroactively alter the agreement you made.
